Allgemeine Geschäftsbedingungen für Bestellungen bei Masika Art & Designs1. Geltungsbereich
Unter die allgemeinen Geschäftsbedingungen (nachfolgend «AGB» oder «AGB – Onlineshop» genannt) fallen alle Rechtsgeschäfte, die über den Onlineshop www.masikaart.com abgeschlossen werden.
Dieser Onlineshop wird von Masika Art and Designs (nachfolgend auch «Verkäufer» genannt), CH-241.1.015.381-8 gem. Zefix Schweiz, geführt. Wir behalten uns das Recht vor, die vorliegenden AGB jederzeit zu ändern.
2. Bereitgestellte Informationen
Masika Art & Designs bemüht sich, die veröffentlichten Daten im Onlineshop aktuell und korrekt zu halten.
3. Angebot
Die Produkte und Preise im Onlineshop gelten als Angebot. Das Angebot gilt, solange das Produkt im Onlineshop auffindbar und vorrätig ist.
4. Bestellungen
Bestellungen werden über www.masikaart.com vorgenommen:
4.1. Die Produkte im Online-Shop werden mit Informationen wie Grösse, Farbe, Preis und Materialien ausgezeichnet.
4.2. Während der Bestellung wählst du dein Produkt anhand der Größe, Farbe, Menge und ggf. weiteren Merkmalen aus.
5. Wie kaufe ich im Online-Shop ein?
5.1. Du legst das ausgewählte Produkt aus dem angebotenen Sortiment durch Anklicken des Buttons „in den Warenkorb” unverbindlich in den virtuellen Warenkorb.
5.2. Alle Artikel, die im Warenkorb abgelegt worden sind, können eingesehen werden, wenn auf den im oberen Teil der Internetseite sichtbaren “Warenkorb” geklickt wird. Hier können auch Artikel gelöscht oder deren Anzahl geändert werden.
5.3. Wenn die Artikel aus dem Warenkorb gekauft werden sollen, ist auf den Button “weiter zur Bestellung” zu klicken.
5.4. Der Kauf ist ohne Registrierung möglich.
5.5. Wähle deine Liefermethode und -adresse aus und gib deine Zahldaten an.
5.6. Anschliessend kannst du angeben, wie du bezahlen möchtest. Dir stehen die folgenden Zahlungsarten zur Verfügung: PayPal, Sofortüberweisung, Twint, PostFinance und Kreditkartenzahlung (Visa/MasterCard).
5.7. Nach Auswahl der Zahlungsart bestimmst du die Liefermodalitäten und die Lieferanschrift. Nach der Auswahl der Liefermodalität kannst du weitere Produkte kaufen oder dir die Bestellübersicht anzeigen lassen.
5.8. Durch das Anklicken des Buttons „Kaufen“ gibst du verbindlich einen Antrag zum Kauf der im Warenkorb befindlichen Waren ab. Zuvor musst du durch Setzen eines Häkchens diese AGB akzeptieren und damit in deinen Antrag aufnehmen.
Die Bestellung ist für dich verbindlich, sofern du die Bestellung nicht innerhalb von 15 Minuten nach der Aufgabe storniert. Dies kannst du über den Button „Bestellung stornieren“ tun.
Willst du deine Bestellung ändern, musst du die Bestellung stornieren und mit dem neuen Produkt den Bestellvorgang durchlaufen.
5.9. Als Verbraucher hast du ein Widerrufsrecht, dies wird nicht durch das o.g. Verfahren berührt.
5.10. Du kannst jederzeit während des Bestellvorgangs bis zur Zahlung auf die Abgabe einer verbindlichen Bestellung verzichten. Dazu genügt es, dass du keine weiteren Schritte vornimmst und die Bestellseite verlässt. Hierzu kannst du den Button anklicken, mit dem du auf die vorherige Unterseite zurückgehen oder jede beliebige Unterseite oder ein Produkt auf der Internetseite www.masikaart.com anklickst. Eine nicht abgegebene Bestellung wird nicht an dich versandt.
5.11. Nach Erhalt der Bestellung schicken wir dir eine Eingangsbestätigung per E-Mail zu, in welcher deine Bestellung nochmals aufgeführt wird. Diese bedeutet noch keinen Kaufvertragsabschluss. Der Kaufvertrag kommt erst mit Versendung der Versandbestätigung zustande.
Die Versandbestätigung erfolgt binnen zwei Tage nach Eingang der Bestellung.
5.12. Der Verkäufer kann sich mit dir telefonisch (soweit eine Telefonnummer von dir angegeben wurde) oder per E-Mail in Verbindung setzen, um etwaige noch offene Fragen hinsichtlich der Bestellung und Lieferung zu klären. Die Verwendung der Telefonnummer und der E-Mail erfolgt ausschliesslich zu dem Zweck, die Bestellung und die Lieferung abzuwickeln und wird ausdrücklich nicht für Werbezwecke benutzt, es sei denn, es liegt hierzu eine ausdrückliche Einwilligung von dir vor..
5.13 Der Vertragstext wird Dir mit der Eingangsbestätigung zu Deiner Bestellung unmittelbar nach Eingang der Bestellung übersendet. Darüber hinaus wird er bei uns nicht gespeichert und ist nicht mehr abrufbar.
6. Preise
6.1. Masika Art & Designs kann die Preise frei festlegen und jederzeit ändern. Bei der Bestellung ist der auf der Website veröffentlichte Preis massgebend. Sind Preise irrtümlich veröffentlicht worden, behält sich Masikaart vor, dies der:dem Käufer:in vor dem Versand mitzuteilen um eine Preiskorrektur zu vereinbaren oder den Auftrag zu stornieren.
6.2. Alle im Online-Shop angegebenen Preise sind jeweils in CHF einschliesslich der gesetzlich gültigen Mehrwertsteuer angegeben. Hinzu kommen noch die Versandkosten, deren Höhe von der ausgewählten Liefer- und Zahlungsweise abhängig ist und die separat ausgewiesen wird. Bevor du die Bestellung absendest, wird der Preis einschließlich der jeweils gültigen gesetzlichen Mehrwertsteuer und anfallender Versandkosten nochmals angezeigt.
6.3. Der Preis, der am Ende einer Bestellung angegeben wird, ist der finale Preis. Verkäufer als auch Käufer sind daran gebunden. Anschließend wird der Preis sich nicht mehr ändern, auch wenn der Verkäufer möglicherweise zu einem späteren Zeitpunkt den Preis für die Ware reduziert oder anhebt.
7. Produktverfügbarkeit
Die im Online-Shop angebotenen Produkte sind grundsätzlich lieferbar. In seltenen Ausnahmefällen, z.B. wenn ein bestimmte Artikel durch eine Vielzahl von Kunden bestellt wird, lässt sich jedoch nicht ausschließen, dass das Produkt nicht mehr verfügbar ist. Du wirst dann unverzüglich über die Nichtverfügbarkeit des Produkts informiert. Ein Vertrag über die nicht verfügbare Artikel kommt nicht zustande. Die Lieferung erfolgt, solange der Vorrat reicht.
Auf der Produktseite sind nicht verfügbare Größen mit einer anderen Farbe markiert als die verfügbaren Größen. Produkte mit nicht verfügbaren Größen werden nicht in den Warenkorb eingelegt, können aber zu einer Wunschliste hinzugefügt werden.
Du kannst dich für den Versand einer Benachrichtigungsmail bei wieder vorliegender Verfügbarkeit anmelden. Die Einwilligung zur Speicherung der Daten, der E-Mail-Adresse sowie deren Nutzung zum Versand der E-Mails kannst du jederzeit widerrufen. Der Widerruf kann über einen Link in der Benachrichtigungsnachricht selbst oder per E-Mail an folgende E-Mail-Adresse erfolgen: [email protected]
8. Zahlungsarten
Dir stehen die folgenden Zahlungsarten zur Verfügung: PayPal, Bankberweisung, PostFinance, Twint, und Kreditkartenzahlung (Visa/MasterCard).
Bei der Auswahl der Zahlungsart PayPal wirst du automatisch auf deine PayPal-Seite weitergeleitet. Für alle anderen Zahlungsarten wirst du automatisch auf die Seite des Zahlungsdienstleisters Wallee , https://wallee.com/de/, weitergeleitet.
Wenn du eine Onlinezahlung auswählst PayPal, Banküberweisung, beginnen wir mit dem Versand, sobald uns der volle Rechnungsbetrag gutgeschrieben wurde. Erst dann fängt die oben genannte Lieferfrist an zu laufen.
Hinweis: Wir werden dir nie per E-Mail eine Änderung unseres Bankkontos mitteilen und dann die Zahlung des Kaufpreises mittels einer Überweisung anfordern. Eine solche Nachricht ist zu ignorieren und es ist keine Zahlung vorzunehmen. Wir bitten dich in einem solchen Fall, die erhaltene E-Mail-Nachricht an [email protected] weiterzuleiten.
9. Versandkosten
Wir versenden in der Schweiz und weltweit.
Die Höhe der Versandkosten hängt von der gewählten Versandart ab.
Bestellungen im Wert von über 150 CHF sind kostenlos.
10. Lieferbedingungen und Abholung
Als «verfügbar» markierte Produkte werden ab dem Bestellungseingang normalerweise innerhalb von 0 – 2 Arbeitstagen zwischen Dienstag und Freitag geliefert bzw. stehen an der Abholadresse (Masika Art and Designs, Froburgstrasse 9, 4657 Dulliken, Schweiz) zur Abholung bereit. Samstags und sonntags findet kein Versand statt, Abholungen können getätigt werden, sofern eine entsprechende Abholungseinladung versandt wurde. Ist ein Produkt nicht vorrätig oder fälschlich als «verfügbar» markiert, wird dies der Kundin per E-Mail oder telefonisch mitgeteilt und ein neuer provisorischer Liefer- oder Abholtermin vereinbart. Der Verkäufer bemüht sich um eine rasche Nachlieferung und versendet Warenrückstände ohne zusätzliche Versandkosten.
Ist ein Artikel gar nicht mehr verfügbar und kann vom Verkäufer auch nicht mehr beschafft oder produziert werden, kann der Verkäufer vom Vertrag zurücktreten, muss jedoch der Kundin bereits geleistete Zahlungen für das betreffende Produkt vollständig zurückerstatten.
Ist der Verkäufer nicht in der Lage, die Artikel innerhalb von 30 Kalendertagen ab Eingang der Bestellung (Ausnahme Spezialbestellungen, gem. Art. 6.2), bereitzustellen oder zu versenden, hat die Kundin das Recht, vom Vertrag zurückzutreten. Von der Käuferin bereits für das betreffende Produkt getätigte Zahlungen an Masika Art & Designs werden vollständig zurückerstattet. Es bestehen keine darüber hinausgehenden Ansprüche gegenüber Masika Art & Designs.
Entstehen zusätzliche Versandkosten aufgrund einer falschen Lieferadresse oder falscher Adressdaten, so gehen diese Kosten vollständig zu Lasten der Käuferin.
Falls nicht anders vereinbart versendet Masika Art & Designs nationale und internationale Bestellungen mit der Schweizerischen Post.
11. Vertragsabschluss
Der Kaufvertrag kommt durch das Absenden (online) der Bestellung und der Annahme durch Masikaart zustande.
Voraussetzung für einen gültigen Kaufvertrag ist das vollständig und wahrheitsgemässe Ausfüllen des im Internet bereitgestellten Bestellformulars und das Akzeptieren der hier vorliegenden Allgemeinen Geschäftsbedingungen (AGB – Onlineshop).
Masikaart bestätigt den Eingang der Bestellung mit einer automatisch generierten Auftragsbestätigung per E-Mail. Diese zeigt der Kundin lediglich an, dass die Bestellung eingetroffen ist und dass der Kaufvertrag unter der Bedingung der Liefermöglichkeit und der korrekten Preisangabe zustande gekommen ist.
12. Widerrufsbelehrung
Du hast das Recht, binnen vierzehn Tagen ohne Angabe von Gründen diesen Vertrag zu widerrufen. Die Widerrufsfrist beträgt vierzehn Tage ab dem Tag, an dem du oder ein von dir benannter Dritter, der nicht der Beförderer ist, die Waren in Besitz genommen habt.
Um dein Widerrufsrecht auszuüben, musst du uns, mittels einer eindeutigen Erklärung (z.B. E-Mail, Telefonanruf) über deinen Entschluss, diesen Vertrag u widerrufen, informieren.

10.2. Folgen des Widerrufs
Wenn du diesen Vertrag widerrufst werden wir dir alle Zahlungen, die wir von dir erhalten haben, einschließlich der Lieferkosten (mit Ausnahme der zusätzlichen Kosten, die sich daraus ergeben, dass du eine andere Art der Lieferung als die von uns angebotene, günstigste Standardlieferung gewählt hast), unverzüglich und spätestens binnen 14 Tagen ab dem Tag zurückzuzahlen, an dem die Mitteilung über deinen Widerruf dieses Vertrags bei uns eingegangen ist.
Für diese Rückzahlung verwenden wir dasselbe Zahlungsmittel, das du bei der ursprünglichen Transaktion eingesetzt hast, es sei denn, mit dir wurde ausdrücklich etwas anderes vereinbart; in keinem Fall werden dir wegen dieser Rückzahlung Entgelte berechnet.
Wir können die Rückzahlung verweigern, bis wir die Waren wieder zurückerhalten haben oder bis du den Nachweis erbracht hast, dass du die Waren zurückgesandt hast, je nachdem, welches der frühere Zeitpunkt ist.
13. Freiwilliges Rückgaberecht
Wir gewähren für Einkäufe neben dem gesetzlichen Widerrufsrecht ein freiwilliges Rückgaberecht für 30 Tage ab Warenerhalt.
Mit diesem Rückgaberecht kannst du dich auch nach Ablauf der 14-tägigen Widerrufsfrist (siehe Ziffer 10. Widerrufsrecht) vom Vertrag lösen, indem du die Ware innerhalb von 30 Tagen nach Erhalt (Fristbeginn am Tag des Warenerhalts) an uns zurückschickst. Zur Fristwahrung reicht die rechtzeitige Absendung aus.
Dieses Rückgaberecht ist jedoch nur unter der Voraussetzung gegeben, dass die Ware in ihrem ursprünglichen Zustand unversehrt zurückgeschickt wird, d.h. du hast sie nur anprobiert, aber nicht getragen.
Die Rückzahlung erfolgt auf das dir zur Zahlung verwendete Konto. Hast du per PayPal gezahlt, erfolgt die Rückerstattung auf das damit verbundene PayPal-Konto.
Wir weisen darauf hin, dass das gesetzliche Widerrufsrecht von dem freiwilligen Rückgaberecht unangetastet bleibt und unabhängig daneben besteht. Durch das freiwillige Rückgaberecht findet auch keine Einschränkung des Gewährleistungsrechts statt.
14. Gewährleistung
14.1. Du hast Anspruch auf Gewährleistung für Mängel der gekauften Waren nach den gesetzlichen Vorschriften. Insbesondere kannst du Nacherfüllung (Neulieferung oder Mängelbeseitigung) verlangen. Wir sind jedoch berechtigt, dich auf Neulieferung zu verweisen, wenn die Mängelbeseitigung mit unverhältnismäßigem Aufwand verbunden wäre.
14.2. Wir bitten dich, deine Gewährleistungsansprüche unter Angabe der Bestellnummer, deines Namens und deiner Anschrift sowie unter kurzer Angabe der Gründe geltend zu machen. Sende die Ware bitte auf eigene Kosten an folgende Anschrift

15. Eigentumsvorbehalt
Die Ware bleibt bis zur vollständigen Kaufpreiszahlung im Eigentum des Verkäufers.
16. Urheberrechte
Der Inhalt dieser Website, einschliesslich Fotos, Filmen und Texten, ist durch Urheberrechte und andere Rechte geschützt. Eine Verwendung der Bilder, Filme und Texte ist nur zur privaten Nutzung zulässig, jede weitergehende Nutzung ist ohne ausdrückliche schriftliche Einwilligung des Verkäufers nicht gestattet.
17. Datenschutz
Masika Art & Designs erfasst nur personenbezogene Daten, die für den Vertragsabschluss nötig sind. Diese werden ohne die gesonderte Zustimmung der Käuferin nicht weiterverarbeitet.
Die Daten werden nur an Drittparteien weitergegeben, wenn dies für die Abwicklung des Auftrags notwendig ist. Dies betrifft bei einer Heimlieferung den Logistikpartner (z.B. Post, DHL, etc.) und bei der Zahlungsabwicklung das Kreditinstitut (z.B. Wallee, Stripe etc.).

18. Rechtsanwendung und Gerichtsstand
Die Beziehung zwischen Masika Art & Designs und der Kundin untersteht ausschliesslich dem schweizerischen Recht. Gerichtsstand ist die Stadt Olten, Kanton Solothurn, Schweiz.

General Terms and Conditions for Orders from Masika Art & Designs1. Scope
The General Terms and Conditions (hereinafter referred to as “GTC” or “GTC – Online Shop”) apply to all legal transactions concluded via the online shop www.masikaart.com.
This online shop is managed by Masika Art and Designs (hereinafter also referred to as the “Seller”), CH-241.1.015.381-8 according to Zefix Switzerland. We reserve the right to change these terms and conditions at any time.
2. Information provided
Masika Art & Designs makes every effort to keep the data published in the online shop up-to-date and correct.
3. Offer
The products and prices in the online shop are considered an offer. The offer is valid as long as the product can be found in the online shop and is in stock.
4. Orders
Orders are placed via www.masikaart.com:
4.1. The products in the online store are labeled with information such as size, color, price and materials.
4.2. During the order, you select your product based on the size, color, quantity and, if applicable, other features.
5. How do I shop in the online shop?
5.1. You place the selected product from the offered assortment in the virtual shopping cart without obligation by clicking the button “add to shopping cart”.
5.2. All items that have been placed in the shopping cart can be viewed by clicking on the “shopping cart” visible at the top of the website. Articles can also be deleted or their number can be changed here.
5.3. If the items are to be purchased from the shopping cart, click on the “continue to order” button.
5.4. The purchase is possible without registration.
5.5. Select your delivery method and address and enter your payment details.
5.6. You can then specify how you would like to pay. The following payment methods are available to you: PayPal, Sofortüberweisung, Twint, PostFinance and credit card payment (Visa/MasterCard).
5.7. After selecting the payment method, you determine the delivery modalities and the delivery address. After selecting the delivery modality, you can buy additional products or view the order overview.
5.8. By clicking on the “Buy” button, you submit a binding application to purchase the goods in the shopping cart. Before that, you must accept these terms and conditions by ticking a box and thus include them in your application.
The order is binding for you unless you cancel the order within 15 minutes of placing it. You can do this by clicking on the “Cancel order” button.
If you want to change your order, you must cancel the order and go through the ordering process with the new product.
5.9. As a consumer, you have a right of withdrawal, this is not affected by the above-mentioned procedure.
5.10. You can waive the submission of a binding order at any time during the ordering process until payment has been made. All you have to do is not take any further steps and leave the order page. To do this, you can click on the button that takes you back to the previous subpage or click on any subpage or product on the website www.masikaart.com. An order that has not been placed will not be shipped to you.
5.11. Upon receipt of the order, we will send you a confirmation of receipt by e-mail in which your order is listed again. This does not yet mean the conclusion of a purchase contract. The purchase contract is only concluded when the shipping confirmation is sent.
The shipping confirmation will be sent within two days of receipt of the order.
5.12. The Seller may contact you by telephone (if a telephone number has been provided by you) or by e-mail to clarify any outstanding questions regarding the order and delivery. The use of the telephone number and the e-mail is exclusively for the purpose of processing the order and the delivery and is expressly not used for advertising purposes, unless you have given your express consent.
5.13 The text of the contract will be sent to you with the confirmation of receipt of your order immediately after receipt of the order. In addition, it is not stored by us and can no longer be retrieved.
6. Prices
6.1. Masika Art & Designs is free to set prices and change them at any time. When placing an order, the price published on the website is decisive. If prices have been published in error, Masikaart reserves the right to inform the buyer of this before shipment in order to agree on a price correction or cancel the order.
6.2. All prices quoted in the online shop are quoted in CHF including the statutory value added tax. In addition, there are the shipping costs, the amount of which depends on the selected delivery and payment method and which is shown separately. Before you send the order, the price will be displayed again, including the applicable statutory value added tax and any shipping costs incurred.
6.3. The price quoted at the end of an order is the final price. Sellers as well as buyers are bound by it. Subsequently, the price will not change, even if the seller may reduce or raise the price of the goods at a later date.
7. Product Availability
The products offered in the online shop are generally available. However, in rare exceptional cases, e.g. if a certain item is ordered by a large number of customers, it cannot be ruled out that the product is no longer available. You will then be informed immediately of the unavailability of the product. A contract for the unavailable items is not concluded. Delivery will be made while stocks last.
On the product page, unavailable sizes are marked with a different color than the available sizes. Products with unavailable sizes will not be added to the shopping cart, but can be added to a wish list.
You can sign up to receive a notification email when availability returns. You can revoke your consent to the storage of the data, the e-mail address and their use for sending the e-mails at any time. The revocation can be made via a link in the notification message itself or by e-mail to the following e-mail address: [email protected]
8. Payment methods
The following payment methods are available: PayPal, bank transfer, PostFinance, Twint, and credit card payment (Visa/MasterCard).
If you select the payment method PayPal, you will be automatically redirected to your PayPal page. For all other payment methods, you will be automatically redirected to the page of the payment service provider Wallee, https://wallee.com/de/.
If you choose an online payment PayPal, bank transfer, we will start shipping as soon as we have been credited with the full invoice amount. Only then does the above-mentioned delivery period begin to run.
Hint: We will never notify you by email of a change in our bank account and then request payment of the purchase price by bank transfer. Such a message is to be ignored and no payment is to be made. In such a case, we ask you to forward the e-mail message you receive to [email protected].
9. Shipping costs
We ship in Switzerland and worldwide.
The amount of shipping costs depends on the chosen shipping method.
Orders over 150 CHF are free of charge.
10. Terms of delivery and collection
Products marked as “available” are usually delivered within 0 – 2 working days between Tuesday and Friday from receipt of the order or are available for collection at the pick-up address (Masika Art and Designs, Froburgstrasse 9, 4657 Dulliken, Switzerland). There is no shipping on Saturdays and Sundays, pickups can be made, provided that a corresponding pick-up invitation has been sent. If a product is not in stock or incorrectly marked as “available”, the customer will be informed of this by e-mail or telephone and a new provisional delivery or collection date will be agreed. The seller strives for a quick subsequent delivery and ships backlogs of goods without additional shipping costs.
If an item is no longer available and can no longer be procured or produced by the seller, the seller may withdraw from the contract, but must fully reimburse the customer for any payments already made for the product in question.
If the Seller is unable to provide or ship the items within 30 calendar days from receipt of the order (with the exception of special orders, pursuant to art. 6.2), the Customer has the right to withdraw from the contract. Payments already made by the Buyer to Masika Art & Designs for the product in question will be refunded in full. There are no further claims against Masika Art & Designs.
If additional shipping costs are incurred due to an incorrect delivery address or incorrect address data, these costs shall be borne in full by the buyer.
Unless otherwise agreed, Masika Art & Designs ships national and international orders with Swiss Post.
11. Conclusion of contract
The purchase contract is concluded by sending (online) the order and accepting it by Masikaart.
The prerequisite for a valid purchase contract is the complete and truthful completion of the order form provided on the Internet and the acceptance of these General Terms and Conditions (GTC – Online Shop).
Masikaart confirms receipt of the order with an automatically generated order confirmation by e-mail. This merely indicates to the customer that the order has been received and that the purchase contract has been concluded under the condition that delivery is possible and that the price is correct.
12. Cancellation policy
You have the right to revoke this contract within fourteen days without giving any reason. The revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the goods.
In order to exercise your right of withdrawal, you must inform us by means of a clear declaration (e.g. e-mail, telephone call) of your decision to withdraw from this contract.

10.2. Consequences of revocation
If you revoke this contract, we will reimburse you for all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us), immediately and at the latest within 14 days from the day on which we received notification of your revocation of this contract.
For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this repayment.
We may withhold reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.
13. Voluntary right of return
In addition to the statutory right of withdrawal, we grant a voluntary right of return for purchases for 30 days from receipt of the goods.
With this right of return, you can also withdraw from the contract after the expiry of the 14-day revocation period (see section 10. Right of revocation) by returning the goods to us within 30 days of receipt (beginning of the period on the day of receipt of the goods). Timely dispatch is sufficient to meet the deadline.
However, this right of return is only given under the condition that the goods are returned intact in their original condition, i.e. you have only tried them on but not worn them.
The refund will be made to the account used for payment. If you have paid by PayPal, the refund will be made to the associated PayPal account.
We would like to point out that the statutory right of revocation remains untouched by the voluntary right of return and exists independently of it. Due to the voluntary right of return, there is also no restriction of the warranty right.
14. Warranty
14.1. You are entitled to a warranty for defects in the purchased goods in accordance with the statutory provisions. In particular, you can demand subsequent performance (new delivery or rectification of defects). However, we are entitled to refer you to a new delivery if the rectification of the defect would involve disproportionate effort.
14.2. We ask you to assert your warranty claims stating the order number, your name and address as well as briefly stating the reasons. Please send the goods at your own expense to the following address

15. Retention of title
The goods remain the property of the seller until the purchase price has been paid in full.
16. Copyrights
The content of this website, including photos, films and texts, is protected by copyright and other rights. The use of images, films and texts is only permitted for private use, any further use is not permitted without the express written consent of the seller.
17. Data protection
Masika Art & Designs only collects personal data that is necessary for the conclusion of the contract. These will not be further processed without the separate consent of the buyer.
The data will only be passed on to third parties if this is necessary for the processing of the order. In the case of a home delivery, this applies to the logistics partner (e.g. Post, DHL, etc.) and in the case of payment processing, to the credit institution (e.g. Wallee, Stripe, etc.).

18. Application of law and place of jurisdiction
The relationship between Masika Art & Designs and the customer is subject exclusively to Swiss law. The place of jurisdiction is the city of Olten, canton of Solothurn, Switzerland.
